Zicam Lawsuit Attorneys

Before being recalled in June 2009, Zicam intranasal (administered through the nose) products were popular over-the-counter cold remedies. They are now known to be linked to anosmia, a loss of the sense of smell. Anosmia can be temporary or permanent, and may be full (complete loss of smell), or partial (diminished sense of smell). Partial anosmia is also known as hyposmia. On June 24, 2009, Matrixx Initiatives, the manufacturer of Zicam Cold Remedy products, formally recalled three of their zinc-based products, saying that it desired to cooperate with the FDA, but "vigorously disagreed" with the government health agency's allegation that their products caused smell loss. As of June of 2009, Matrixx Industries had received more than 800 reports of smell loss related to Zicam products.

FDA Warning Regarding Zicam Intranasal Cold Remedy Products

Citing the potential to cause loss of sense of smell, the FDA advised consumers to immediately stop the use of three intranasal Zicam Cold Remedy products on June 16, 2009: Zicam Cold Remedy Nasal Gel, Zicam Cold Remedy Swabs, and Zicam Cold Remedy Swabs "Kids Size" (previously discontinued).  On the same day, the FDA issued a stern warning letter to Zicam's manufacturer, saying their products could “pose a serious risk to consumers who use them”, and said the Zicam products were “misbranded.”

Active Ingredient Zinc Gluconate

The main ingredient in the three recalled intranasal Zicam products is soluble zinc gluconate. Intranasal zinc products were first utilized to treat polio during the years of the great depression, and have been linked to causing loss of smell since then. Despite knowledge of the potential to cause loss of smell, and receiving hundreds of reports of anosmia, Zicam did nothing to tell consumers they could lose their sense of smell. Because Zicam is marketed as a homeopathic remedy, it is not subject to the same rigorous testing by the FDA as over-the-counter medications. Anosmia has been reported with the first dose or multiple doses. In many cases, due to permanent damage to the olfactory nerve, the loss of sense of smell is permanent.
