Manufacturing Defect Attorneys

Despite the exhaustive efforts of independent consumer safety advocate organizations and regulations set forth by federal government agencies, including the National Highway Traffic Safety Administration (NHTSA), the United States Product Safety Commission (CPSC) and the United States Food and Drug Administration (FDA), consumers are injured by dangerous and defective products every year. When a defect can be linked to something that occurred in the manufacturing process, as opposed to being defective due to the way it was designed, the defect is called a manufacturing defect.

Manufacturing Defects vs. Design Defects

When a product has a design defect, every single product that is manufactured will have the defect. Some examples of defective products with design defects could be flammable children's pajamas, a step-stool designed with only three legs that cannot handle a person's weight, or a gas tank on a car placed near the trunk that causes the car to easy catch fire in a low impact rear-end crash.  On the other hand, manufacturing defects can occur even with the most careful design. The defect occurs at some point while the product is being built. Examples include medicine manufactured with too much of a main ingredient, or auto sheet metal manufactured using the wrong formula which causes it to easily break, or an airbag assembled with too much sodium azide propellant. Many manufacturing defects can be attributed to human error in the assembly or manufacturing process.

Manufacturing Defects and Product Recalls

It is possible that you could be injured by a defective product, and the product you used or purchased was the only defective product made. However, it is also possible that other people have been injured by the same defect.  If other defective products were made and sold, the manufacturer or importer may issue a recall, in cooperation with the agency that oversees safety issues related to it. A defective pacemaker may be recalled in cooperation with the FDA, a defective bicycle may be recalled in cooperation with CPSC, and a defective gas pedal may be recalled by its manufacturer in cooperation with the NHTSA. It is important to note that just because a product has not been recalled does not mean the manufacturer is not liable for your injuries. Keep the Defective Product

A very important note: If you suspect you've been injured by a defective product, keep it. Do not have it repaired and do not discard it, whether it is contaminated medicine or a defective vehicle. If it is a food product, keep any unconsumed leftover product. No matter what the product is, it is important evidence to your case. If you hire an attorney, your attorney will need to have the product inspected to determine how it caused or contributed to your injuries. If somebody else owns the product, contact an attorney as soon as possible so that evidence can be preserved before it is lost or destroyed.
