Defective Drop Side Crib Lawsuits
Drop side cribs are infant cribs with three immovable sides and a fourth side that moves up and down. The cribs are popular because they allow parents or caregivers easy access to infants. However, many of the cribs have been subject to recalls after babies and young children have been injured or killed because of design defects and manufacturing defects of the cribs. The Consumer Product Safety Commission (CPSC) has known of the many possible dangers of drop side cribs since 1978. In 2009, major crib manufacturers agreed to a proposal that would ban sales of drop side cribs in the U.S., and require all four sides of the cribs to be rigidly attached together.
Recent Drop Side Crib Recalls
In the last 30 years, dozens of drop side cribs have been recalled for numerous defects, hazards and dangers. You can search for recalls of your crib by visiting cpsc.gov. The following are some, but not all, of the large scale drop side crib recalls in recent years:
- April 2009 – Simplicity and Graco Cribs : 1.2 million different Simplicity and Graco cribs were recalled because of a flaw in the crib's design that allowed parents to potentially install the drop rail part of the crib upside-down, which can weaken the hardware. Three deaths in different models of cribs were attributed to this design defect. The cribs were sold at department stores and children’s product stores from January 1998 until May 2007, and include the following models: Aspen 3 in 1, Aspen 4 in 1, Nursery in a Box, Crib N Changer Combo, Pooh 4 in 1, Chelsea, and the following cribs with the Graco logo: Aspen 3 in 1, Ultra 3 in 1, Ultra 4 in 1, Ultra 5 in 1, Trio, and Whitney. The model numbers are: 4600, 4605, 4705, 5000, 8000, 8324, 8800, 8740, 8910, 8994, 8050, 8750, 8760, and 8996.
- June 2009 - Bonavita “Cabana” Drop Side Cribs: About 2,000 Bonavita “Cabana” Drop Side Cribs were recalled in June 2009, because the wooden crib slats can detach or break, creating a gap, which could pose an entrapment and strangulation hazard to infants and toddlers. The cribs were sold at USA Baby, Beautiful Beginnings, Buy Buy Baby and other specialty stores nationwide from January 2006 through May 2009 for about $450.
- November 2009 – Stork Craft Drop side Cribs: More than 2.1 million Stork Craft Cribs were recalled, including about 147,000 Stork Craft drop side cribs with the Fisher-Price logo. The recall involved about 1,213,000 units distributed in the United States and 968,000 units distributed in Canada. According to the CPSC, the plastic hardware on the drop side part of the crib can break, deform, or parts may become missing. Like other crib defects, the drop side may be installed upside-down. Major retailers in the United States and Canada sold the recalled cribs including BJ’s Wholesale Club, J.C. Penney, Kmart, Meijer, Sears, USA Baby, and Wal-Mart stores and online at Amazon.com, Babiesrus.com, Costco.com, Target.com, and Walmart.com from January 1993 through October 2009 for between $100 and $400.
- January 2010 – Diana Cribs: About 1,000 Diana Cribs distributed by Caramia Furniture and Mother Hubbard's Cupboards were recalled because the slats on the cribs' drop side can detach from the top and bottom rails of the crib, posing a fall and entrapment hazard to the child. The cribs were sold at Buy Buy Baby and juvenile product and mass merchandise stores nationwide from September 2002 through December 2005 for between $240 and $370.
- February 2010 - Generation 2 Worldwide and “ChildESIGNS” Drop Side Crib Brands: The CPSC announced the recall of all Generation 2 Worldwide and “ChildESIGNS” cribs, warning parents and caregivers who own these drop side cribs that infants and toddlers are at risk of serious injury or death due to strangulation and suffocation hazards presented by the cribs. The recalled cribs were sold at numerous local furniture and retail stores including Buy Buy Baby, and Kmart and Wal-Mart stores nationwide for between $60 and $160. Three deaths and 20-other non-fatal incidents were reported related to these cribs.
