Defective Bicycle Lawsuit Attorneys

At Estey & Bomberger, founding partner Mike Bomberger oversees all cycling accident litigation. As a competitive cyclist who rides several hundred miles a week, Mike is aware of the many things that can go wrong with a bicycle and the dangers that cyclists face on the road. Defective bicycle parts can cause the rider to lose control of the bicycle and fall, or crash with a vehicle, pedestrian, or another cyclist, resulting in serious injury or death. If the accident results from a component of the bicycle that is defective, an attorney can help the injured victim obtain compensation for his or her injuries in a product liability claim.   Some common examples of defective bicycle parts include:

  1. Chains that break
  2. Defective design that causes the chain to easily fall off
  3. Defective tires
  4. Defective tire tubes
  5. Faulty frame welding
  6. Hand brakes that snap off
  7. Improper assembly
  8. Pedals or cranks that crack
  9. Suspension forks that separate from the frame or break.

Bicycle Defects and Recalls

Bicycles have a long history of defects and recalls. In 2009, the United States Consumer Product Safety Commission (CPSC) announced more than a dozen recalls of bicycles, bicycle parts and cycling accessories. There are three types of possible defects that may cause or contribute to an accident: (1) Design defects (defects that result from poor design of the bicycle); (2) Manufacturing defects (defects that occurred in the manufacturing of the bicycle); and (3) Failure to warn defects (defects that cause accidents that could be prevented if proper instructions accompanied the product).

What to Do After an Accident

Immediately after any bicycle accident, seek medical attention for your injuries. This is essential not just for your health, but also for documenting your case. Visiting your doctor or the hospital will document your injuries and establish a record of the extent of your injuries. Once you've sought the treatment you need, contact an experienced bicycle accident lawyer with experience in bicycle defects. It is never too early to contact a lawyer after an accident. The sooner you contact an attorney, the faster evidence can be preserved and your attorney can begin your claim.

Keep the Bicycle

Keep the bike! With any defective product claim, the plaintiff (injured victim) must be able to demonstrate that a problem with the bike (a manufacturing defect, design defect, or failure to warn defect) caused the accident or failed to reasonably protect the cyclist in the event of an accident. Until your attorney can arrange to have the bicycle inspected, do not have it repaired or destroyed, and do not take apart the bike or otherwise tamper with it.

Contact an Attorney

Product liability claims are time sensitive. It is important to contact an attorney soon after a case to begin  the process of gathering evidence and building your case. A statute of limitations imposes strict time limits on how long you have to bring a claim against the manufacturer of the bicycle or any other responsible party. Contact a lawyer at Estey & Bomberger today to determine your rights in a defective bicycle product liability claim.
