Airbags, along with seat belts, are designed to save lives and lessen the extent of injuries in automobile accidents. Despite their purpose to prevent injuries and save lives, airbags can cause serious injury or death when they deploy too early, too late or not at all. In other cases, airbags cause serious injury when they deploy in low-impact accidents that would have resulted in no injuries if the airbag had not deployed.

NHTSA Airbag Rules and Regulations

There is little doubt that airbags have saved thousands of lives. The National Highway Traffic Safety Administration (NHTSA), the agency of the US government that oversees automobile safety standards, has cited that airbags have saved 22,466 lives. The NHTSA also says that since 1990, 284 people have died due to faulty or defective airbags. Over the years, the NHTSA has issued regulations to reduce the number of airbag-related injuries and fatalities, and generally make airbags safer. Most of these regulations or relatively broad standards, and manufacturers are not obligated to use specific airbag designs.

Factors that Cause or Contribute to Airbag Injuries

Various factors relating to both the vehicle, the airbag itself, and the occupant can affect how beneficial an airbag is and the risk of airbag injuries. These include:

  1. How the airbag is folded;
  2. How the airbag is tethered;
  3. How the airbag vents / deflates;
  4. The angle of airbag deployment;
  5. The inflated volume of the airbag;
  6. The number of sensors used;
  7. The occupant position in relation to the airbag;
  8. The position of the seat in relation to the airbag;
  9. The rate at which the airbag deploys;
  10. The shape of the airbag module;
  11. The threshold at which the airbag deploys;
  12. The type of material inside the airbag;
  13. The type of sensors used (optical electric or infrared);
  14. The weight of an occupant;
  15. Whether the airbag has lateral-bias flaps; and
  16. Whether the occupant is wearing a seatbelt.

What To Do After An Accident

After any accident resulting in even minor injury, your immediate priority should be getting the medical attention you need. Do not release the vehicle to the insurance company or have it repaired until you speak with an airbag injury lawyer. Your attorney can have the vehicle inspected to determine if an airbag, or lack of airbag deployment, caused or contributed to your injuries or a loved one's death.
