What is Product Liability?

The area of law that governs compensation to injured consumers and those killed by defective products, devices and pharmaceutical products is product liability law. Product liability law holds designers, manufacturers, distributors and retailers liable for injuries to buyers and users of defective and dangerous products. Companies may be held liable under negligence, strict liability or breach of warranty claims.

Proving a Product is “Defective”

A product can be “defective” in three ways: a product can be defectively designed, defectively manufactured, or defectively marketed. Design defects occur on paper, before the manufacturing process begins. If a product is defectively designed, every single product manufactured will contain the defect. Manufacturing defects occur during the assembly or manufacturing process. If a product is defectively manufactured, only a few or certain number may contain the defect. Defects in marketing may result from improper instruction or failures to warn consumers of dangers. An example could be a skin product that says “safe on sensitive skin” but in fact causes a severe rash.

Government Regulation and Standards of Public Safety

The United States Consumer Product Safety Commission (CPSC) oversees the protection of consumers from harm caused by consumer products, and takes action when necessary against the manufacturers of products from BBQ grills to all-terrain vehicles. However, the CPSC may not learn of potential dangers until consumers are already injured. When consumers use products in good faith and suffer injury, they deserve compensation.

The United States Food and Drug Administration (FDA) regulates safety of pharmaceutical products, medications and medical devices. Much like the CPSC, the FDA often does not learn of hazards until doctors and consumers report problems.
